Are You Eligible for Medical Cannabis in Delaware?

In order for an adult or minor to obtain medical marijuana, they must meet the following requirements:

  • $50 fee
  • Must be 18 years of age or older; minor patients must meet additional requirements
  • Physician certification and be diagnosed with a qualifying medical condition
  • Completed application with all related forms and requirements

What Are the Medical Cannabis Program’s Qualifying Conditions?

If you want to obtain a medical card for the Delaware medical marijuana program, you must be a resident of Delaware and have a qualifying medical condition.

Patients must obtain a physician certification (expires with 90 days) from a licensed doctor that has performed a medical evaluation and determined that medical marijuana treatment could treat the patient’s condition

Qualifying conditions:

  • Terminal illness
  • Cancer
  • HIV/AIDS
  • Decompensated cirrhosis
  • Hepatitis C
  • ALS/Lou Gehrig's disease
  • Agitation of Alzheimer's disease
  • PTSD
  • Intractable epilepsy
  • Autism with self-injurious or aggressive behavior
  • Glaucoma
  • Chronic debilitating migraines
  • Chronic or debilitating disease or medical condition that produces one or more of the following:
    • Cachexia (wasting syndrome)
    • Severe, debilitating pain that has not responded to previously prescribed medication or surgical measure for more than three months, or for which other treatment options produced serious side effects
    • Intractable nausea
    • Seizures
    • Severe or persistent muscle spasms, including those characteristic of multiple sclerosis

For minor patients, the program’s qualifying conditions include:

  • Intractable epilepsy or a chronic or debilitating disease or medical condition where they have failed treatment involving one or more of the following symptoms:
    • Autism with self-injurious or aggressive behavior
    • Cachexia (wasting syndrome)
    • Intractable nausea
    • Severe, painful, and persistent muscle spasms

What Does the Medical Cannabis Program in Delaware Allow?

In Delaware, licensed medical cardholders are allowed to use medical cannabis to treat their qualifying conditions.

  • Medical possession limit: For adult patients, 3 oz of flower every 14 days for a total of up to 6 oz of flower per month; Minors are limited to cannabis oil of at least 15% CBD and no more than 7% THC
  • Medical cultivation limit: No home cultivation

How to Apply for a Medical Marijuana Card in Delaware

The Office of Medical Marijuana encourages patients and caregivers to mail in their applications to the MMP office instead of delivering them in person. The Delaware medical marijuana online application information is available online or here for minors.

  • Patient information: Includes contact and demographic information as well as a patient attestation that you will follow the program's rules.
  • Physician certification: A licensed physician must complete this section indicating they are licensed to practice medicine in Delaware, they have performed a medical evaluation, and recommended medical cannabis for your qualifying condition.
  • Patient release request: Allows the Delaware Health and Social Services to contact your physician to verify the application information.
  • Proof of residency: Include a copy of your state driver's license or state-issued ID card.
  • Application fee: Pay a non-refundable $50 application fee (check or money order payable to the state of Delaware)

Once you complete your application, review it to make sure that all the information provided is correct. If any information is missing, your application will be sent back for completion.

Once your information has been verified, the Department must approve or deny your application within 45 calendar days of receipt. Once approved, you will be issued a card by mail.

There is a $20 replacement fee for cards. You can mail in a request or go in person to obtain a replacement.

Can Out-of-State Residents Apply For a Medical Card in Delaware?

No. Only Delaware residents can apply for a medical cannabis card in the state.

Can You Use Medical Cannabis Anywhere in Delaware?

 No. Medical cannabis use is not authorized in the following locations:

  • On a school bus
  • The grounds of any preschool, primary, or secondary school
  • The grounds of any correctional facility
  • The grounds of any healthcare treatment facility operated by the Department or funded contractually through the Department
  • In any form of transportation
  • In any public place
