What is Legal in Virginia With Cannabis?

Possession:
Adults can legally possess up to one ounce of marijuana. This includes both dried flower and cannabis products.


Private Consumption:
Adults have the right to consume marijuana in private residences. Smoking or using marijuana in public places remains prohibited.


Home Cultivation:
Individuals are allowed to grow up to four marijuana plants in their homes. However, these plants must not be visible from public areas and should be inaccessible to individuals under the age of 21. It is required to attach a legible tag to each plant, containing the grower's name, driver's license or ID number, and a statement indicating that the plant is for personal use in compliance with the law.


Sharing with Other Adults:
Adults aged 21 and older can share up to one ounce of marijuana with another adult, as long as no money or anything of value is exchanged.


Next Steps and Retail Cannabis Sales in Virginia:
Although possession and cultivation for personal use have been legalized, the implementation of retail sales of recreational marijuana in Virginia is still pending.
