Is Cannabis Legal in Kentucky?
Medical and recreational cannabis use is illegal in Kentucky. Lawmakers have tried decriminalizing cannabis and setting up a medical program, but proposals have failed. In June 2022, Governor Andy Beshear created a Medical Cannabis Advisory Board and plans to legalize medical cannabis through executive action.
Although Kentucky prohibits commercial cannabis sales, cannabidiol (CBD) is legal in the state if it is derived from hemp containing less than 0.3% THC. CBD-infused products are available throughout the state in hemp CBD stores. Hemp production and sales are now viable business options in Kentucky.
