Hemp-derived CBD is legal.

Colorado voters legalized adult-use marijuana in 2012 (Amendment 64), with retail sales beginning January 2014. Adults 21 and older may legally possess up to two ounces of marijuana and purchase it from licensed retail stores regulated by the Marijuana Enforcement Division. Retail marijuana is taxed separately from the general state sales tax.

Colorado's medical marijuana registry, created by Amendment 20 (2000) and run by CDPHE, lets patients with qualifying debilitating conditions such as cancer, HIV/AIDS, seizures, chronic pain, and PTSD obtain a registry card after a provider certification and a $52 application fee. A card for a debilitating condition is valid one year. Colorado does not recognize out-of-state patients.

Licensed retail marijuana stores may sell to any adult 21 or older with valid ID; licensed medical centers sell only to registered patients or their caregivers presenting a valid registry card. Retail sales are capped at 1 ounce of flower (or its equivalent, including concentrate) per transaction, with a separate cap of 8 grams of concentrate per person per day. Registered medical patients are capped at 2 ounces of flower, 8 grams of concentrate, or a combined 20,000 mg of THC in products per business day, unless a physician certifies a higher amount.

Simple possession of two ounces or less carries no penalty for adults; larger amounts escalate from a $100 petty offense to misdemeanors and eventually felonies as weight rises, and sale, cultivation, and distribution follow a similar weight-tiered scale up to 32 years for the largest trafficking amounts. Driving with 5 ng/mL or more of THC in blood creates a permissible inference of impairment; DUI is a misdemeanor that becomes a felony after three prior convictions. Colorado allows expungement of past marijuana convictions for conduct that is now legal.

Colorado's licensed marijuana market sells flower, edibles, concentrates, tinctures, topicals, and vape products, subject to state testing, child-resistant packaging, and labeling requirements. Hemp products with no more than 0.3% THC are separately legal, and nonintoxicating hemp-derived CBD may be sold as an ordinary hemp product.
Federal hemp change: from December 11, 2026 the federal definition of hemp counts total THC, including THCA, and final hemp products with more than 0.4 mg of total THC per container are no longer hemp; products with cannabinoids the plant cannot naturally produce stop counting as hemp on November 12, 2026. What changes, state by state (P.L. 119-37 § 781; P.L. 119-103 § 2019).

Retail (recreational) marijuana is taxed with a 15% state excise tax on wholesale transfers from cultivation facilities plus a separate 15% state retail marijuana sales tax on consumer sales, and is exempt from the regular 2.9% state sales tax. Medical marijuana instead pays the regular 2.9% state sales tax. Local governments may add their own additional marijuana taxes. Colorado collected about $236.4 million in marijuana tax and fee revenue in 2025.

The Marijuana Enforcement Division, within the Department of Revenue, licenses cultivation, manufacturing, testing, and retail marijuana businesses. There is no statewide numeric cap on the number of retail licenses, but a city, county, or city and county may prohibit or further restrict marijuana businesses locally. Out-of-state and publicly traded investors may hold financial interests, but all natural persons with day-to-day operational control of the business must be Colorado residents.
