Illinois legalized recreational cannabis for adults 21 and older effective January 1, 2020, becoming the first state to do so via its legislature rather than a ballot initiative. Cannabis is sold through licensed dispensing organizations supplied by licensed cultivation centers, craft growers, and infusers, with strict possession limits, packaging, and advertising rules.

Small amounts within the legal possession limit carry no penalty for adults 21+; low-level unlicensed possession above the limit is typically a misdemeanor, escalating to felonies (up to life-range sentences and $200,000 fines) for large-scale possession, cultivation, or sale. Persons under 21 are not covered by the adult-use law: possessing 10 grams or less is a civil violation with a $100 to $200 fine, and larger amounts are criminal misdemeanors or felonies. Cannabis DUI remains illegal, tied to a 5 ng/mL THC blood standard, and the state is expunging an estimated 700,000 past cannabis records.

Cannabis cultivation is taxed at a 7% privilege tax; adult-use sales carry a tiered purchaser excise tax of 10%, 20%, or 25% depending on product type and THC potency, on top of standard state/local sales tax (medical sales instead use the lower ~1% qualifying food-and-drug rate). Municipalities and counties may add their own cannabis-specific retail taxes, and revenue funds administration, expungement processing, and other state programs.
