Pennsylvania has a medical-only cannabis program. Act 16 of 2016 (the Medical Marijuana Act) created a state-licensed system of grower/processors and dispensaries regulated by the Department of Health for patients with one of 24 qualifying serious medical conditions. Recreational marijuana remains illegal and is a Schedule I controlled substance. Hemp and CBD at or under 0.3% THC are legal and regulated separately by the Department of Agriculture under a permit program.

Recreational/adult-use cannabis is illegal in Pennsylvania. Several bills to legalize adult-use cannabis have been introduced in recent sessions but none had passed as of September 2026, so all non-medical possession, cultivation, and sale remain criminal offenses under state law.

The Department of Health administers a registry of patients and caregivers. Patients need certification from an approved practitioner for one of 24 qualifying conditions, then pay $50 for an ID card (waived for some benefit programs) valid up to one year. Caregivers must be 21+, pass a background check, and may serve an unlimited number of patients, while a patient may designate up to two caregivers. Practitioners may certify patients remotely by phone or video under Act 44 of 2021. Medical marijuana is sold as pill, oil, topical, tincture, liquid, or a vaporization/nebulization form (including dry leaf); smoking is prohibited.

Registered medical patients may possess up to a 90-day supply of individual doses as recommended by their practitioner and dispensing pharmacist; the law sets no separate ounce, gram, or milligram cap.

Only registered patients (18 or older, or through a caregiver for minors, homebound, or assistance-dependent patients) may purchase medical marijuana, and only from a Pennsylvania-licensed dispensary. Purchases are limited to a 90-day supply of individual doses per the practitioner's certification; there is no separate numeric ounce, gram, or milligram purchase cap, and there is no legal recreational purchase channel.

Home cultivation of cannabis is not allowed for anyone, patient or caregiver alike; only Department of Health-permitted grower/processors may cultivate, and only in an indoor, secure, enclosed facility. A 2025 Senate bill (SB 76) proposing to allow patients 21+ to grow at home for personal use had not passed as of September 2026.

Unlicensed marijuana activity is prosecuted under the state's general Controlled Substance Act. Small-amount possession (30g flower/8g hashish or less) for personal use is a lesser misdemeanor (up to 30 days/$500), while larger possession, cultivation, and distribution are felonies punishable by up to 5 years and $15,000 (up to 10 years/$100,000 for over 1,000 pounds). Paraphernalia offenses carry up to 1 year/$2,500. Driving with any detectable amount of a Schedule I substance (including THC) is a per se DUI, with escalating mandatory minimum jail time and fines for repeat offenses. Arrest records for dismissed or acquitted drug charges can be expunged.

Legal medical marijuana product forms are pill, oil, topical (gel/cream/ointment), tincture, liquid, and a vaporization or nebulization form (including dry leaf/plant); smoking and dispensary-sold edibles are not allowed, though patients may make their own edibles at home. Products must be sold in sealed, labeled packages showing dose count, THC/CBD percentage, packaging date, and required warnings. Regulations define a standard 'medical marijuana unit' as 3.5 grams of dry leaf, 1 gram of concentrate, or 100 milligrams of THC in an infused product, and cap a 90-day supply at 192 units.
Federal hemp change: from December 11, 2026 the federal definition of hemp counts total THC, including THCA, and final hemp products with more than 0.4 mg of total THC per container are no longer hemp; products with cannabinoids the plant cannot naturally produce stop counting as hemp on November 12, 2026. Pennsylvania taxes medical marijuana with a 5% tax on the gross receipts a grower/processor earns selling to a dispensary, paid by the grower/processor and not itemized to the patient. The retail sale of medical marijuana itself is exempt from Pennsylvania sales tax, though marijuana accessories (vaporizers, grinders, storage containers, etc.) are subject to ordinary sales and use tax. There is no separate local or municipal cannabis tax and no separate cultivation-specific tax beyond the 5% wholesale tax.

The Department of Health originally could license up to 25 grower/processors and 50 dispensaries (each with up to 3 locations); 2018 clinical-registrant provisions and 2023 amendments (Sections 617-619) now let the department issue further permits, and the department listed 200 dispensary locations with product as of September 16, 2026. Permits are evaluated on merit-based criteria (regional need, applicant fitness, security plans) rather than a lottery. Initial dispensary permits cost $5,000 to apply plus a $30,000 permit fee per location; grower/processor permits cost $10,000 to apply plus $200,000. Limited vertical integration is allowed. Independent laboratory testing is required for all medical marijuana. There is no residency requirement for business owners, only for patients and caregivers.
